This website is owned by Vollie Pty Ltd (“Vollie”, “We”, “Us” or “Our”).

Your access to this website is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained in these terms of use (collectively “Terms of Use”) and otherwise contained on www.vollie.com.au (“Site”).

Your use of, and/or access to, this Site constitutes your agreement to the Terms of Use. We reserve the right, at Our sole discretion, to amend the Terms of Use by posting the revised Terms of Use at any time and without notice to you. Such amendments will be effective upon posting. It is therefore your responsibility to read these Terms of Use carefully and check these Terms of Use periodically for amendments. Your continued use of the Site following the posting of changes will be construed as evidence that you accept and agree to all such amendments.

A copy of the current Terms of Use is displayed on the Site at all times.

PRIVACY POLICY

Our privacy policy (“Privacy Policy”) applies to all use of this Site, and its terms are hereby made a part of these Terms of Use.

We will only share your personal information with third party volunteering organisations that are applicable to your profile and listed skills. We will not other share any of your user information with external parties unless expressly authorised by you to do so.

Where you provide any personal or sensitive information directly to a third party, whether through direct contact with other members on the Site, through posting information publicly on the Site or otherwise, you acknowledge and agree that We have no responsibility in respect of that disclosure. We retain the right at all times to monitor, retain and disclose any information as necessary for us to satisfy our obligations under any applicable laws, or to maintain the Site in line with these Terms of Use.

Additionally, by using the Site you acknowledge that Internet transmissions are not always private or secure. You understand that while We implement and maintain security and safety measures against loss of data and information, any information you send to the Site may be read or intercepted by others, even if particular transmissions are encrypted.

LIMITATION OF LIABILITY

You accept all risks and responsibility for all loss, damage, costs and other consequences resulting from your use of the Site or the content, postings or material on or accessible through the Site (including any other content or transactions conducted through the Site or any linked site).

Except as expressly stated in these terms, or in any applicable warranty provided with certain goods, and to the extent permitted by law, We will not be liable for any loss, expense, damage, or injury that is suffered (however so caused) arising from or in connection with:

a.     any individual user’s access to, or use of, or inability to use the Site or the content or materials of the Site (including linked websites);

b.     contact between any user of the Site and any organisation which partners with Us;

c.     the safety or suitability of any user of the Site in providing services to any organisation which partners with Us; or

d.     the suitability of any volunteering program or position offered or undertaken by any user of the Site,

whether based in contract, tort, negligence, statute or any otherwise, except for any liability that cannot be excluded by law.

You agree and acknowledge that your use of the Site and any contractual negotiations or a binding agreements entered into with other parties as a result of using the Site or any goods or services procured through the Site, in no way act to bind Us, or otherwise make Us a party to your dealings or obligations.

INTELLECTUAL PROPERTY RIGHTS

Unless this Site expressly indicates to the contrary, all information, text, material, graphics, software and advertisements appearing on this Site from time to time (“Content”) are either Our property or the property of the users/organisations who posted the Content. As such, the Content is protected by Australian and international copyright and trademark laws, and in relation to Our property, We reserve all rights accordingly.

You must not modify, copy, adapt, store in a retrieval system, reproduce, upload, post, transmit, sell, frame or embed in another website or distribute in any way any Content contained on or in the Site and owned or licensed by Us, except as expressly approved by Us in writing or as permitted under the Copyright Act 1968 (Cth) or any other relevant Legislation.

On the express condition that users keep all Content intact and in the same form as originally presented on this Site (including without limitation all copyright, trademark and other proprietary notices and all advertisements), We grant you permission to do the following with the material on the Site:

(a)     store a reproduction of the material on your local computer for the sole purpose of viewing the material; and

(b)     print hard copies of material for your personal information, but not commercial use.

Users must not use this Site in any manner or for any purpose which is unlawful or in any manner which violates any of Our rights or which is otherwise prohibited by the Terms of Use.

COMMUNICATION FACILITIES AND INFORMATION USE

This Site may from time to time contain volunteering advertisements, electronic bulletin boards, chat rooms and other facilities which may be used by users to communicate with organisations with potential volunteer programs or positions (“Communication Facilities”). These Communication Facilitates may allow for the provision of feedback by users and members to Us, such as real-time interaction between users and organisations and other electronic messaging and notice services.

If any user of the Site, whether individuals or organisations contribute postings or any Content to the Site, you grant Us a royalty free, worldwide, perpetual, non-exclusive, and irrevocable licence to use, publish, translate, distribute, reproduce and modify anything you submit to this Site or write about the Site (including emails), in any form, and by any current or future media or technology. You consent to Us not attributing your authorship to any of your postings to this Site. We may also publicly display any information that you submit.

However, in utilising these Communication Facilities, you must not:

(a)        restrict or inhibit any other user or member from using or accessing any part of this Site;

(b)        use the Site to post or transmit any information or material that is unlawful, threatening, abusive, defamatory, pornographic, profane or otherwise offensive information or material of any kind, including, without limitation any information or material that might reasonably encourage conduct that would breach any civil or criminal law of the Australian Capital Territory or other applicable place, breach the rights of any applicable third parties, or is contrary to any relevant standards or codes;

(c)         tamper with, hinder the operation of, or make unauthorised modifications to the Site, including the removal of any copyright, trade mark or other proprietary rights notices contained in or on the Site;

(d)        knowingly transmit any viruses, worms, defects, trojan horses or other component designed to harm or hinder the hardware, software or other facilities of Us or any of Our users or members;

(e)        use any means to retrieve or index any portion of the Site, or collect any information about other users or Our user accounts;

(f)          modify, adapt, translate, or reverse engineer any portion of the Site, including reformat or framing any portion of the web pages that are part of the Site;

(g)        create user accounts by automated means or under false or fraudulent pretences;

(h)        use the Site to transfer or store illegal material including that which may be deemed threatening or obscene;

(i)          create volunteering opportunities for the sole purpose of collecting personal information of individual applicants; or

(j)          with the exception of posts which advertise specific volunteering opportunities, post or transmit any information or material that advertises or promotes another business or website without the prior written consent of Us.

We reserve the right to monitor, review or remove the Contents of the Communication Facilities. However, We shall not be responsible to ensure that users of any form do not post information, material or file that is offensive, contravenes any applicable law or right or is misleading or deceptive.

VOLUNTEERING SERVICES

The volunteer positions or program opportunities which may be advertised on the Site are offered by our volunteer organisation partners (VOPs).

Once individuals register with the Site, they will be able to view any opportunities made available on the Site by our VOPS. Users may then submit their personal information, including their name, contact information, work history and skills to our VOPs through the Site for allowing the VOP to assess your suitability for filing any opportunity.

All VOPs posting projects on the Vollie platform must ensure these projects are realistic and achievable for the volunteers applying for that project. Where possible, a VOP should detail the time required to complete the project and date that the project is due. Once the work required is completed, the VOP posting the project must mark the project as complete.

By applying for projects with a VOP, volunteers are confirming availability and ability to complete that particular project for the VOP. If accepted, volunteers agree to give your best effort to complete that project to your best ability and in timeframes agreed with the VOP.

The VOP may advise Us of the successful and unsuccessful applicants, and We will inform each applicant directly through the Site via an email push notification and, when required, a personal communication through the contact details provided. 

Where an individual chooses to accept a position with a VOP, that arrangement is solely between the individual and the VOP. Vollie disclaims all liability and responsibility for the suitability, safety or conduct of any program or position advertised by our VOPs.

We give no undertaking as to the availability of volunteering services on the Site. We make no warranty that opportunities made available on the Site will meet your requirements. Details contained on this Site relating to volunteering opportunities have been prepared by our VOPs in accordance with Australian law and may not satisfy the laws of any other country.

VOPs are not entitled to charge any costs for applying to their programs or positions. Any individual who accepts a volunteer position with a VOP must engage directly with the VOP regarding terms and conditions that apply to the specific VOP, position or program.

Unless otherwise stated at the time, any contractual obligations entered into between parties as a result of your participation in any advertised volunteering services are between yourself and the third party. This includes any rights associated with intellectual property created during participation in any volunteering activity. We will not accept any liability or otherwise be held accountable for the contractual negotiations or agreements resulting from those services.

You acknowledge and agree, that unless otherwise agreed in writing with a VOP, then:

(a)   all work, including intellectual property rights in that work, created by you in relation to a project of the VOP will belong to, and is assigned on creation to, the VOP (the VOP Materials);

(b)   you have no right to personally use any of the VOP Materials;  

(c)    you may not use or showcase any of the VOP Materials in your resume or portfolio of works;

(d)   the information received from the VOP posting the project is private and confidential and must not be shared with any third parties.

NO ENDORSEMENT

This Site may, from time to time, contain hyperlinks, advertisements, banners and /or other pointers to advertisements and Internet websites operated by third parties (“Linked Websites”). The Content and any resulting dealing from such advertisements and Linked Websites are the responsibility of the Content owners as listed on the Site and are not under Our control nor endorsed by Us. As such, We do not make any warranties or representations regarding the quality, accuracy, merchantability or fitness for purpose of any product or material of these advertisements or Linked Websites. We do not accept any responsibility for the Contents of advertisements found on our Site nor does We specifically endorse the content of the Linked Websites. Users and members rely on the representations made in any advertisements on the Site and link to any such Linked Website and use or rely on such website entirely at their own risk.

NO SPAM

Any publication of e-mail addresses on the Site is for the purpose of professional communication only. Our e-mail addresses must not be used to send unsolicited commercial electronic messages.

SEVERABILITY

If any part of these Terms of Use is deemed invalid, that part will be severed from this agreement and the remainder of these Terms of Use will continue to be valid and enforceable. 

GOVERNING LAW

This agreement is governed by the laws of Victoria, Australia. You irrevocably and unconditionally submit to the exclusive jurisdiction of the laws and courts of Victoria, Australia.

TERMINATION

The Terms of Use are effective until terminated or amended by Us. We may terminate this agreement and user and member access to this Site at any time without notice (excepting where we are bound by the terms of any separate service agreements). In the event of termination, all restrictions imposed on users and members, licenses granted by users and members and all of Our disclaimers and limitations of liability set out in the Terms of Use will survive. In the case of members, Our liability will be limited to a refund of any unused portion of any fee paid.

MISCELLANEOUS

All rights not expressly granted herein are reserved.

Vollie Pty Ltd Privacy Policy

Vollie Pty Ltd (we, us or our) is committed to respecting the privacy and security of our volunteers, not-for-profit partners and businesses using the platform.

Through the provision of our programs and services we may need to collect and use personal information about individuals, with the three main types of information being categorised as:

1. Sensitive Personal Data – We generally do not collect or use personal financial or medical information. Corporate financial information is kept secure where necessary through appropriate electronic security measures. If we do have to collect sensitive personal data for any reason we will only do so with an individual’s express consent as to what information may be collected, and how the information may be used.

2. Personal Data – Information through which it is possible to identify individuals directly (names, addresses, contact information etc). Individuals will always know when this data is being collected through the completion of applicable registration processes or the specific request for this information to be provided for a specified purpose; and

3. Aggregated Statistical Data - All other non-personal information that relates purely to generic statistics – whether that be via use of electronic mediums such as websites, or through participation statistics in our programs and activities.

Sensitive Personal Data

Where it is necessary to do so, we only collect sensitive personal data where there is a specific need to do so.

If we store sensitive personal data for any reason it is only to meet the needs of a particular program or activity and any applicable legislative requirements. If that purpose is no longer applicable, that information is deleted.

Personal Data

We will only collect, use and transfer your Personal Data if you have consented to that collection, use and transfer, except in circumstances where it is necessary to conform to legal requirements; protect and defend our rights or property; or to protect the interests of other users. By making applications on our website and providing personal information, you have consented to such collections, use and transfer.

This data is generally collected through registration systems, whereby you are required to enter accurate contact information to allow for the use of our services. Providing incorrect information (ie using a pseudonym or inaccurate name, address or telephone number) may require the disclosure of your personal information to our affiliates and trading partners to allow for rectification of incorrect or incomplete records.

Where personal data is collected through automated registration, such as registration using other social media platforms, including LinkedIn™, we may allow for pseudonyms or anonymous access where such access does not adversely affect our systems or our business needs.

If consent has been given during the collection process, we may use personal information to contact you with relevant material; or to disclose that information to other select third party companies (partners or affiliates) and for those companies to contact the person with other relevant material.

You may opt out from receiving marketing material at any time by sending an email containing your name and other identifying information along with the header “Opt Out of Marketing” to [email protected]].

Disclosure of Data to Third Parties

The Vollie platform is designed to connect volunteers with organisations with available volunteer positions. Where a person uses our services there is an expectation that we will disclose your personal information to third party volunteer organisations to the extent necessary to allow those partners to assess your suitability for their volunteer positions and programs, and to contact you if successful.

It is important to note that any information that you disclose to our partners directly will not be covered by this Privacy Policy. This includes but is not limited to any contact information, financial or reputational data or any other sensitive or personal data that may allow the third party to identify you.

Overseas Recipients

We may disclose your information to overseas affiliates for the purpose of operating, maintaining and updating our site and other associated electronic formats. Overseas affiliates, if used, are likely to be based in the United Kingdom, the United States and Asia Pacific.

Where you have provided consent, any third parties that information is passed on to for marketing purposes are likely to be based in Australia, but may on occasion be based overseas. Where Personal Data is to be transferred overseas, the recipient Third Party will be advised of their requirement to apply the Australian Privacy Principles set out in the Privacy Act 1988 (Cth) to that information.

On occasion we may collect Personal Data in other ways – e.g. through online forms, participation activities, via email or telephone communications or other occasional services.

Aggregated Data

By using our website or other electronic mediums, other non-personal information will be collected and used by us through the use of cookies and other electronic collection methods and may be transferred to third parties.

Participation statistics for our programs and events will be collected without any individual being identifiable.

In addition to non-personal information collected through the ordering or registration or registration processes associated with our programs and activities, information is automatically collected about traffic around our web site. This is also only used in aggregate form and no individual user will be identified.

Cookies

We may use "cookies" to speed up access to our website and to enhance your experience of the site by customising it according to your interests. A cookie is a small piece of information sent from our website to your computer to help us to identify you quickly. It is possible for you to disable these cookies by changing your browser settings, but this may slow down or prohibit access to parts of the site.

Advertising Agencies

In the event that adverts for other companies are used on our website, these are served to the site on our behalf by agents. The agent may use cookies for statistical purposes and to ensure that you do not see the same adverts all the time, and to try and make sure that you see adverts that will be of interest to you.

In particular this site may use the services of Google Analytics for the serving and/or targeting of ads, promotions and other marketing messages. Should an individual require access to, or wish to correct the Sensitive Personal Data (if any) and/or Personal Data collected and stored by us, an email with the relevant contact details should be sent to [email protected]. We will endeavour to provide access or correct information, where that action is reasonable and practicable. Pursuant to the Australian Privacy Principles we may impose a reasonable fee for this service where it is reasonable to do so.

Making a Complaint

If you wish to make a complaint with regard to a possible breach of this Policy or the Australian Privacy Principles, or for complaints regarding handling of your other requests or enquiries in relation to this policy this can be done by emailing us at [email protected].

What happens to my complaint?

Ø   When we receive your complaint we will contact you when reasonably practicable to let you know that we have received it. 

Ø   We will use reasonable endeavours to investigate the complaint and aim to resolve it.  We may contact the person for further information.

Ø   We will write to the person and let them know the outcome. We will use reasonable endeavours to resolve the complaint within 30 days however some complaints are more complex and take longer. We will keep the person informed if this is the case.

Ø   If for some reason we cannot resolve the complaint (for example, the issue is outside our responsibilities), we will write to the person and let them know.
