Vollie’s Volunteer Terms of Service

Vollie Pty Ltd (Vollieweus or our) is really excited to have you on board! Before we can begin our awesome journey together, there are a few things to which we need your agreement. These are our terms of service. By joining Vollie, using our services and applying for or participating in opportunities, projects or programs with our Volunteer Organisation Partners (VOPs), you agree at all times to comply with these terms of service.

Volunteer Services

Upon joining Vollie, you can view and apply for the volunteering opportunities presented on this website (www.vollie.com.au) (the Site) by our VOPs. The Vollie platform caters for a broad range of organisations with whom you can volunteer your expertise. VOPs include not for profit organisations and also social enterprises (i.e. companies that operate as a traditional for-profit enterprise but who are also committed to a particular social or altruistic cause).  

You may submit your personal information, including your name, contact information, work history and skills to our VOPs through the Site, allowing the VOP to assess your suitability for filling any opportunity.

If you are under 18 years old, you may join Vollie subject to Vollie obtaining your parent’s or guardian’s written consent that they agree to these terms and conditions. Your parent or guardian must sign a copy of these terms and conditions and return them to us via email to [email protected] prior to you using any of Vollie’s services.

By applying to participate in any opportunities with a VOP, you confirm your availability and ability to complete that particular project for the VOP. You are also confirming that you have made sufficient and prudent enquiries regarding the particular project and that you have the necessary skills and experience to perform the tasks required of you as part of the project. If accepted for the project by a VOP, you agree to complete that project to your best ability and otherwise in accordance with any standards and/or timeframes that you may agree upon with the VOP.

All volunteer positions, volunteer projects or other volunteer program opportunities advertised and/or published on the Site (each a Project) are offered by, and have been prepared by the relevant VOP to which the Project relates, and not by or for Vollie. The publication by Vollie of the Projects on the Site does not represent any form of endorsement or approval by Vollie as to the suitability or otherwise of any particular VOP or the advertised Projects. When you choose to accept a Project with a VOP, that arrangement, and any contractual obligations under that arrangement, is solely between you and the VOP. You must make your own enquiries and satisfy yourself as to the appropriateness or otherwise of the proposed terms of engagement for the Project. You may have legal rights and obligations in respect of your engagement to complete a Project. Vollie cannot provide legal advice to you, or any party, in relation to the terms of engagement between you and a VOP.  

VOPs reserve the right to request proof of your experience, education and skills at any time prior to, during or after participation in a Project to verify your suitability and competency for that Project. A VOP may, at any time, terminate the volunteer relationship if you refuse to provide proof as requested, or if a VOP determines that your experience, education and skills are not suitable for a specific Project.

You understand that during your volunteering services (i.e. completion of the Project), you may be privy to information or processes that are regarded by the VOP as confidential (Confidential Information). You  agree to only use Confidential Information  for the purpose of completing the Project and any other purpose that a VOP may authorise in writing. You will not disclose such Confidential Information to any third party without the VOP’s written consent.

Volunteers agree to use the Vollie platform solely for the intended purpose of skilled online volunteering. You must not charge  or quote your services to VOPs in respect of any Project. A breach of this clause will result in the immediate cancellation of your account.

Warranties

You warrant to us on a continuing basis that:

a) the information provided by you, including (but not limited to) your skills and experience, are at all times accurate, up-to-date and complete;

b) you have made your own sufficient enquiries about the VOP (including to understand whether or not they are a not-for-profit entity or a private social enterprise);

c) you have made your own sufficient enquiries about the Project in relation to which you are applying to ensure it is appropriate having regard to  your specific skills and experience;

d) you will at all times act lawfully when engaging with Vollie  and in the performance of a Project; and

e) you are not aware of any actual or potential conflict of interest affecting your ability to participate in any VOP project to which you have applied. For example, you warrant that the performance of the Project does not breach any obligation that you owe to your employer or to a client.

Disclaimer, Release and Indemnity

Vollie gives no undertaking as to the availability or suitability of Projects on the Site. We make no warranty that Project opportunities advertised on the Site will meet your requirements or that any Projects comply with all applicable laws in the jurisdiction to which they relate. Vollie does not endorse the credibility or authenticity of any VOP or its Projects and we will not accept any liability or otherwise be held accountable for the contractual negotiations or agreements resulting from any arrangement between you and a VOP.

Vollie, together with its officers, employees, agents and contractors (collectively the Vollie Parties) will not be liable for, and to the maximum extent permitted by law you release the Vollie Parties from, any claim or liability in respect of any loss, injury or damage whatsoever or howsoever caused which you may suffer or incur, as a result of or in connection with your application for, reliance on, or involvement in any Project or any other opportunity with a VOP, including (but not limited to):

a) any false, inaccurate or incomplete information relating to the Projects advertised by a VOP;

b) the suitability, safety and conduct of any Project, program or position advertised by or on behalf of a VOP; and

c) any breach, by you or the VOP, of your terms of engagement with the VOP.

You must indemnify and must continue to keep indemnified the Vollie Parties against any and all claims, actions, costs, liabilities, charges, penalties, fines, payments or damages we suffer, incur or are liable for as a result of your application for or involvement in any Project or opportunity with a VOP.

Intellectual Property

You acknowledge and agree that, unless otherwise agreed in writing with a VOP:

a)  any intellectual property rights in any new work product or deliverables created by you in relation to a Project  belongs to, and is assigned on creation to, the VOP (the VOP Materials);

b) you have no right to personally use any of the VOP Materials; and

c) you may not use or showcase any of the VOP Materials in your resume or portfolio of works.

For the purpose of this clause, VOP Materials excludes any pre-existing materials or intellectual property that you bring to the Project.

General Provisions

Vollie may immediately terminate or suspend your access from the Site or prevent you from applying to participate in any Project at any time and for any reason, at its sole discretion.

You understand and agree that these terms of service do not create any relationship of partner, agency, employment, trust, partnership or joint venture as between you and Vollie.

These terms of service constitute the entire agreement between you and Vollie. The agreement created by these terms of service are governed by the laws in force in the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the Courts of Victoria.

Vollie’s VOP Terms of Service

Vollie Pty Ltd (Vollie, we, us or our) provides a platform for Volunteer Organisation Partners (VOPs) to advertise opportunities, programs and projects (each a Project). These terms and conditions represent our agreement with our VOPs and which governs our relationship with our VOPs. By becoming a VOP with Vollie, accessing and using our services and posting or advertising opportunities, projects or programs through us, you must at all times comply with these terms of service. If you do not agree to be bound by these terms of service, please do not use the Vollie service.

Posting Opportunities

As a VOP, you can access this website (www.vollie.com.au) (the Site) and advertise Projects on the Site (each a VOP Advertisement) that may be viewed and applied for by volunteers who have joined Vollie.

VOPs acknowledge and agree that Vollie is a platform designed to facilitate the advertisement of your Projects and to connect VOPs with prospective volunteers who may be able to complete or otherwise participate in your Projects. Vollie is a platform designed to facilitate the connection of VOPS and volunteers. Vollie makes no representations as to the suitability or otherwise of any volunteer on the Site.

VOPs must ensure that all Projects advertised on the Vollie platform are realistic and achievable for the volunteers being asked to apply. VOPs must ensure that each Advertisement that it posts to the Site  includes accurate, truthful, fulsome and not misleading information about the nature of the work, skills and experience required to complete the Project, expected time required to complete the Project and any applicable deadline for completion. Upon completion of the Project, the VOP responsible for the  Project must mark the Project as complete. VOPS are invited to  provide feedback on the Site in relation to the Project, the volunteer(s) involved and their experience generally in using Vollie.

VOPs must not  charge any costs or fees to any person wishing to apply to participate in a Project. Any individual who accepts a volunteer position with a VOP in respect of a Project must engage directly with the VOP regarding terms and conditions that apply to the specific VOP and the specific Project.

You must ensure that all Projects posted to the Site, and the terms upon which the VOP engages a volunteer, comply with all applicable legislation and regulations in the jurisdiction in which the VOP operates including but not limited to laws relating to occupation health and safety and any minimum entitlements.

Accepting Volunteers

VOPs may view the applications of volunteers who have applied for a Project. VOPs can also view information uploaded by the volunteer to the Site including their name, contact details, experience, skills and education. This information includes Personal Information for the purposes of the Privacy Act 2001 (Vic) (the Privacy Act). VOPs must treat any Personal Information disclosed to it by Vollie strictly in accordance with Vollie’s Privacy Policy and the Privacy Act.

As a VOP, you have the right to request proof of a volunteer’s experience, education and skills at any time prior to, during or after participation in a Project to verify the volunteer’s suitability and competency for the Project. Subject to complying with your legal obligations you may end your relationship with a volunteer if they refuse to provide proof as requested, or if you determine that the volunteer’s experience, education and skills are not suitable for a specific Project.

All information relating to volunteers (including name, contact details, abilities, skills, education and experience) (Volunteer Information) is uploaded by the volunteer and not Vollie. The publication by Vollie of Volunteer Information on the Site does not represent any form of endorsement or approval by Vollie as to the suitability or otherwise of a particular volunteer or the accuracy or completeness of the Volunteer Information. Vollie does not vet Volunteer Information or conduct any reference checks etc to verify the accuracy of Vollie Information. VOPs must make their own enquiries as to the accuracy or otherwise of Volunteer Information and the suitability or otherwise of any prospective volunteer for a Project.

If you choose to accept a volunteer’s application for volunteering services, that arrangement and any contractual obligations under that arrangement, is solely between you and the volunteer. VOPs must make their own enquiries as to the suitability of any volunteer they choose to accept. You must ensure that your acceptance of any volunteer and the circumstances under which you operate comply with all applicable legislation and regulations in the jurisdiction in which you operate.

Warranties

You warrant to us on a continuing basis that:

a) all of the information provided by you, including (but not limited to) the Projects that are offered by you, and any information about your services as a VOP, are at all times accurate, up-to-date, complete and in no way misleading;

b) all Advertisements that you post to the Site comply with all relevant laws and are not, for example, misleading or deceptive. Without limitation you must ensure all Advertisements disclose accurate details of the Project requiring completion and details of whether the VOP is a not-for-profit entity or social enterprise;

c) all Projects, including the engagement of volunteers to participate in the completion of the Project, are lawful and do not involve exposure to any unreasonable risk to health or safety; 

d) you will comply with any and all legal requirements, including workplace laws relating to conditions of employment, minimum entitlements and health and safety laws that may apply to your specific Project(s);

e) you have made your own sufficient enquiries about any volunteer you choose to accept for a particular project and that any volunteer you accept suits your project’s needs;

f) you will at all times act lawfully during your use of our service and, without limiting any of the above warranties, any Projects advertised by you will comply with all applicable laws in the jurisdiction in which you operate and which the Project is to be fulfilled; and

g) you will not, at any time, charge a volunteer, or prospective volunteer, any fee or other cost to apply for, or participate in a Project.

Disclaimer, Release and Indemnity

Vollie gives no undertaking as to the availability of volunteers on the Site. We make no warranty that volunteers on the Site will meet a VOP’s particular requirements, even if those requirements have previously been made known to us by you. Vollie does not endorse the credibility, suitability or authenticity of any volunteer or the accuracy of any Volunteer Information. Vollie does not accept any liability and will not be held accountable for the performance of any arrangement between a VOP and a volunteer.

Vollie, together with its officers, employees, agents and contractors (collectively the Vollie Parties) will not be liable for, and to the maximum extent permitted by law you release the Vollie Parties from, any claim or liability in respect of any loss, injury or damage whatsoever or howsoever caused which you may suffer or incur, as a result of or in connection with: 

  1. your use of the service and this Site, 

  2. any Projects advertised by you, 

  3. your reliance on any Volunteer Information;

  4. the performance or conduct of any volunteer that you engage for a Project including any breach by a volunteer of their agreement with Vollie or their agreement with you.

You must indemnify and must continue to keep indemnified the Vollie Parties against any and all claims, actions, costs, liabilities, charges, penalties, fines, payments or damages we suffer, incur or are liable for as a result of any project advertised by you through Vollie or a volunteer’s involvement in any Project with you.

Intellectual Property

For the purposes of Vollie providing its services under these VOP Terms of Service including the promotion of the VOP and individual Advertisements on the Site, the VOP grants Vollie a non-exclusive, sublicensable and royalty free licence to use the:

a) VOP’s name;

b) VOP’s logo/ trade mark; and

c) the VOP Advertisement,

(together, the VOP IP).

Unless otherwise agreed in writing with a volunteer, Vollie’s Volunteer Terms of Services provides that:

a)  any intellectual property rights in any new work product or deliverable created by a volunteer in relation to a Project will belong to, and is assigned on creation to, the VOP (the VOP Materials);

b) volunteers do not have a right to personally use any of the VOP Materials; and

c) volunteers must not use or showcase any of the VOP Materials in their resume or portfolio of works.

For the purpose of this clause, VOP Materials excludes any pre-existing materials or intellectual property that a volunteer brings or contributes to the Project. VOPs must respect the intellectual property rights of all volunteers.

VOP Advertisements on corporate platforms

As part of Vollie’s corporate offering, Vollie may provide corporate clients with access to Vollie’s platform, rebranded with the relevant corporate client’s name and logo. In such cases, the VOP consents to the use of the VOP IP by Vollie and Vollie’s corporate client for the purposes of displaying the VOP Advertisements on the rebranded platform and connecting prospective corporate employees to the VOP’s opportunities.

Payment Terms

All amounts owing to Vollie must be paid up front prior to the VOP posting, or instructing Vollie to post, any Advertisement  on the Site.

General Provisions

Vollie may at any time, and without notice to you, alter the functionality and/or appearance of its products and services available from Vollie or the Site.

Vollie may immediately terminate or suspend your access from the Site or remove or reject any advertised opportunity, project or program if you or an Advertisement in any way breaches these terms of service or for any other reason, at any time at its sole discretion.

You understand and agree that these terms of service do not create any relationship of partner, agency, employment, trust, partnership or joint venture.

These terms of service constitute the entire agreement between Vollie and you and are governed by the law in force in the State of Victoria, Australia. You irrevocably submit to the non-exclusive jurisdiction of the Courts of Victoria.

RMIT UNIVERSITY

Student notification:

  • In this Course, we partner with different third party platform providers to facilitate the engagement with an industry partner. It is a condition of undertaking this Course that students agree:

1) to provide their personal information to a platform provider or industry partner (covered by their respective privacy policies);

2) to the platform provider’s terms of use;

3) that the industry partner will own the intellectual property in the project responses or student submissions (unless agreed otherwise). Students will retain the ability to submit their project responses or submissions as assessments at RMIT. Students must, as with all assessment material, not reproduce other people’s work or infringe any person’s intellectual property.

  • In engaging with industry partners, students will also be required to maintain confidentiality over industry partner information. Students should check with the relevant industry partner whether they are ok to refer to the project submission publicly (eg on LinkedIn).

  • For this Course, we will use the Vollie platform.

  • If you enrol in this Course you will be taken to agree to these additional terms and conditions and privacy policies of the organisations involved.

Partner notification:

  • When engaging with you and preparing a response to your Project, our students agree that you will own the intellectual property in what they submit, and that you can use it for your own purposes (unless agreed otherwise); however students retain the right to submit the Project, and associated documents and works, as their assessment for their course of study with RMIT.

  • In agreeing to participate in a Project you are required to treat our students with respect, and to support them in their learning journey. You must not engage in conduct which is rude or demeaning, or which could constitute bullying, discrimination, victimisation, harassment or any other kind of inappropriate behaviour.

  • Our students are instructed to maintain confidentiality over your information, but you should use appropriate commercial discretion in what information and documents you provide. Similarly, our students are instructed not to infringe third party intellectual property, however we will not be liable for any third party claims made in relation to your use of intellectual property provided to you through this platform.
